Terms of Service — Scene

Welcome to Scene. These Terms of Service ("Terms") govern your use of the Scene mobile application ("App") operated by App Dev Company United LLC, a District of Columbia limited liability company ("Company," "we," "us," or "our").

By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use Scene. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. User Content

Scene allows you to post rankings, comments, a profile bio and an avatar photo ("User Content"). You retain ownership of your User Content. By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, host, store, display, reproduce, modify (for formatting), and distribute your User Content solely in connection with operating, promoting, and improving the App. You represent that you have the right to post any User Content you submit and that it does not violate any third party's rights.

4. Content Standards and Moderation

There is zero tolerance for objectionable content or abusive behavior on Scene. You are solely responsible for your User Content. We may (but are not obligated to) monitor, review, or remove User Content at our sole discretion, and we may remove content or suspend or terminate accounts that violate these Terms or that we deem objectionable, with or without notice. The App provides tools to report content and other members and to block other members. We endeavor to review reports of objectionable content and take appropriate action within 24 hours.

5. Disclaimer Regarding User Content

Rankings, scores, comments and other User Content reflect the personal opinions of the members who post them, and not those of the Company. We do not endorse, verify, adopt, or guarantee the accuracy of any User Content, and we are not responsible or liable for any User Content posted by you or any other member. Any reliance on User Content is at your own risk.

6. Prohibited Conduct

You agree not to:

  • Post content that is defamatory, obscene, harassing, threatening, hateful, or that promotes illegal activity
  • Post content that is sexually explicit, or that exploits or endangers minors
  • Impersonate another person or entity
  • Use the App to spam, solicit, or send unsolicited messages
  • Attempt to gain unauthorized access to the App, other accounts, or our systems
  • Use automated tools (bots, scrapers) to access the App without our written permission
  • Upload content that contains malware or harmful code
  • Interfere with or disrupt the App's functionality
  • Use the App in violation of any applicable law or regulation

7. Copyright Policy

We respect intellectual property rights and expect members to do the same. If you believe content on the App infringes your copyright, send a notice to scene@appdevcompanyunited.com that includes: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and its location in the App; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (e) a statement under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

8. Movie and TV Information

Scene displays movie and TV information — titles, posters, release dates and overviews — supplied by The Movie Database (TMDB). This product uses the TMDB API but is not endorsed or certified by TMDB. We do not guarantee the accuracy, completeness, or timeliness of this information. We are not affiliated with, endorsed by, or partnered with any studio, network or streaming service unless explicitly stated.

9. Intellectual Property

The App, including its design, code, branding, and non-user-generated content, is owned by App Dev Company United LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App without our prior written consent.

10. Feedback

If you send us feedback, suggestions, or ideas about the App, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without restriction or compensation to you.

11. Third-Party Services

The App may integrate with third-party services such as Apple Sign-In, Supabase and TMDB for authentication, data storage and movie information. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the availability or practices of any third-party service.

12. Apple App Store

The following additional terms apply when you download the App from the Apple App Store:

  • These Terms are between you and the Company only, and not with Apple Inc. ("Apple"). The Company, not Apple, is solely responsible for the App and its content.
  • Apple has no obligation to furnish any maintenance or support services with respect to the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, regulatory compliance claims, or consumer protection claims.
  • Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes that third party's intellectual property rights.
  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APP DEV COMPANY UNITED LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

15. Indemnification

You agree to indemnify, defend, and hold harmless App Dev Company United LLC, its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or any third party's rights.

16. Account Deletion

You may delete your account at any time through the App's Settings. Deleting your account will permanently remove your profile, rankings, watchlist, comments, likes, social connections, and all associated data. This action is irreversible.

17. Termination

We may suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

19. Governing Law and Disputes

These Terms are governed by the laws of the District of Columbia, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the courts located in the District of Columbia, and you consent to the personal jurisdiction of such courts.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

21. Survival

Provisions that by their nature should survive termination — including the User Content license, disclaimers, limitation of liability, indemnification, intellectual property, and governing law — will survive termination of these Terms.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and App Dev Company United LLC regarding your use of the App.
